Amini LLC achieves a resounding appellate victory resulting from a high-stakes, 8-figure commercial trial in the Bankruptcy Court against Lynn Tilton, the ”Diva of Distressed”. Amini’s team held Lynn Tilton and her enterprise, Patriarch Partners, accountable for marked breaches of fiduciary duty and fraudulent transfers at the ambulance company Tilton controlled, TransCare, a key 911 operator serving major U.S. cities including all five boroughs of New York City.
The team contested Tilton’s overt mismanagement and her strategies to shield valuable assets from creditors by funneling them into her own separate entity. Led to an 8-figure judgement favoring our client, with Tilton and her company Patriarch Partners facing more than $50 million in liabilities in judgements.
This represents a standout victory for Amini LLC and the firm’s client, Trustee Salvatore LaMonica, particularly given that numerous other plaintiffs, including other trustees and the SEC have been attempting, without success, to recover from Tilton for years.
Reinforced by comprehensive lengthy post-trial decisions from both the Bankruptcy Court (Bernstein, J.) and the District Court (Kaplan, J.), and a 46-page opinion by the 2nd Circuit Court of Appeals.
